Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Stonespace Browser application and related website (together, the "Service"), operated by Sy Torkan ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a subscription. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

2. Description of Service

Stonespace Browser is a macOS desktop application that provides a floating, always-on-top browser window with bookmarking, screenshot, and customization features. The Service requires macOS 13 (Ventura) or later and is not available for Windows, Linux, or any other operating system.

3. Accounts and Registration

To use the Service, you must complete a registration form and purchase a subscription. During registration, you will be asked to provide your name, email address, phone number, and occupation. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your license key and for all activity that occurs under your account.

4. Subscription and Payment

Free Trial: We offer a 14-day free trial. A payment method is required to start the trial. You won't be charged during the trial period. If you don't cancel before the trial ends, your subscription begins automatically and your payment method will be charged.
Billing: Subscriptions are billed monthly on a recurring basis at the price displayed at the time of purchase. All payments are processed through our third-party payment provider, LemonSqueezy.
Price Changes: We reserve the right to change subscription pricing at any time. Price changes for existing subscribers will be communicated in advance.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing cycle.
Taxes: You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction.

5. Refund Policy

If you are unsatisfied with the Service, you may request a full refund within 14 days of your initial purchase by contacting us at support@stonespacebrowser.com. Refunds are issued at our discretion and are limited to one refund per customer. Refund requests made after the 14-day window will not be honored.

6. License and Usage Rights

License Grant: Subject to these Terms and payment of all applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Stonespace Browser for personal purposes.
One Device Per License: Each license is tied to one computer. You cannot run the software on multiple machines at the same time with a single license. To transfer your license to a different device, deactivate on the old one first, then activate on the new one.
Restrictions: You may not: (a) copy, modify, distribute, sell, lease, sublicense, or otherwise transfer the software; (b) reverse engineer, decompile, or attempt to derive the source code; (c) circumvent or tamper with the license validation system; (d) share your license key with others; (e) use the software for any unlawful purpose; or (f) remove or alter any proprietary notices on the software.

7. License Validation

The software periodically connects to the internet to validate your license. This check occurs approximately once per day. If the software cannot reach our validation servers, it will continue to function for up to 14 days using a cached validation. After 14 days without successful validation, the software will become inactive until a connection is restored.

8. Intellectual Property

The Service, including all software, design, text, graphics, logos, and other content, is owned by us and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights in the Service. All rights not expressly granted here are reserved.

9. Privacy and Data Collection

Information We Collect: We collect the information you provide during registration: name, email address, phone number, occupation, and school (if applicable). We also collect a hashed machine identifier used solely for license activation.
How We Use It: Your information is used to manage your account, process payments, communicate with you about the Service, and improve our product. Your machine identifier is used solely for license validation.
Third-Party Services: We use LemonSqueezy to process payments. Your payment information is handled directly by LemonSqueezy and is subject to their privacy policy. Registration data is stored using Google services for record-keeping.
Local Data: The software stores your preferences, bookmarks, and encrypted license information locally on your device. We do not collect your browsing history, bookmarks, or the content of websites you visit.
No Sale of Data: We do not sell, rent, or trade your personal information to third parties.

10. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or compatible with every setup. We do our best to keep things working well and to fix bugs, but use the software at your own risk.

11. Limitation of Liability

We are not responsible for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service. This includes but is not limited to lost data, lost profits, or damage to your computer. Our total liability to you is limited to the amount you've paid us in the 12 months before the issue arose.

12. Termination

By You: You can cancel your subscription and stop using the Service at any time. No questions asked.
By Us: We may suspend or terminate your access if you violate these Terms, if payment fails and isn't resolved, or if we discontinue the product (we'd give you notice first).
After Termination: Your license is revoked and you must uninstall the software. If we terminate your access due to a violation, no refund is provided.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page and notify you by email or website notice. Your continued use of Stonespace Browser after changes are posted means you accept the updated Terms. If you don't agree, stop using the Service and cancel your subscription.

14. Third-Party Content

The Service allows you to browse third-party websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of third-party websites you access through the browser.

15. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
